Murder

A murder charge is perhaps the most serious of all criminal charges. Law enforcement is under immense public pressure to vindicate victims of murder, and as a result, police sometimes rush to charge a suspect based on incomplete or illegally gathered evidence. This can result in a violation of a suspect’s civil rights, a wrongful arrest, or even the prosecution and jailing of an innocent person. For these and other reasons, individuals who have been charged with murder should always seek the counsel of an experienced criminal defense lawyer.

Degrees of Murder

There are two degrees of murder in most jurisdictions: first and second. To prove first-degree murder, the prosecutor must prove intent to kill. First-degree murder charges may also be filed if the victim was:

  • A police officer
  • A witness to a crime
  • A judge
  • Tortured or killed especially violently or heinously

Second-degree murder charges are typically reserved for those who did not plan the killing. In some of these cases, charges can be reduced to voluntary or involuntary manslaughter.

A defendant may also be charged with felony murder, which involves a killing that occurs during the commission of some other crime – bank robbery, for instance.
